Terms & Conditions
These terms explain the conditions that apply when you use the KNZ Car Removals website, request a vehicle quote or arrange an agreed vehicle pickup.
1. Acceptance of These Terms
By using this website, submitting an enquiry, accepting a vehicle quote or arranging a pickup, you agree to these Terms & Conditions to the extent they apply to your interaction with KNZ Car Removals.
A separate written quote, collection confirmation, receipt or transaction document may contain additional details. If there is a direct inconsistency, the specifically agreed transaction document will apply to that transaction, subject to applicable law.
2. Website Information
The website provides general information about KNZ services, including vehicle quotes and towing for agreed pickups across the confirmed service area.
Website content is not a binding offer to purchase every vehicle, provide collection at every location or pay a fixed amount. Vehicle acceptance, price, pickup availability and timing depend on the information supplied and the circumstances of the particular enquiry.
KNZ may correct website errors and update service information without notice. Changes will not override a transaction already specifically agreed in writing unless both parties agree or the law allows it.
3. Vehicle Quotes
A quote is prepared from the vehicle and pickup information supplied by you. This may include the make, model, year, registration or VIN details where requested, running condition, damage, missing parts, photographs, location and towing access.
- A quote may be subject to inspection or verification of the vehicle and its details.
- A quote remains valid for the period stated with it. If no period is stated, confirm that it is still current before arranging pickup.
- “Top Price” describes KNZ’s intention to make a strong vehicle-specific offer; it is not a promise of a particular fixed amount or the highest offer available anywhere.
- “Free Towing” applies to the agreed pickup within the confirmed service area and under the access conditions disclosed when collection is arranged.
If the vehicle or pickup circumstances materially differ from the supplied information, KNZ may explain the difference and provide a revised quote. You may accept or decline a revised quote before the transaction proceeds.
4. Your Ownership or Authority
By offering a vehicle to KNZ, you confirm that you are legally entitled to sell or transfer it, or that you have clear authority from the legal owner to act on their behalf.
You must disclose any finance, security interest, ownership dispute, court order, registration restriction or other claim affecting the vehicle. KNZ may request reasonable identification, proof of ownership, authority, registration information or other documents before purchase or collection.
KNZ may decline or pause a transaction where ownership, authority, vehicle identity or transfer eligibility cannot be reasonably verified.
5. Accurate Vehicle & Pickup Information
You agree to provide information that is accurate to the best of your knowledge and not deliberately misleading. Important facts include:
- whether the vehicle starts, drives, rolls and steers;
- accident, mechanical, flood, fire or body damage;
- missing wheels, keys, battery, engine, transmission or other major components;
- whether the vehicle is registered, unregistered or written off, where relevant;
- vehicle modifications or hazardous conditions known to you;
- the vehicle’s position and any narrow, steep, soft, blocked or restricted access.
You should remove personal belongings, valuables, toll tags, plates where legally required, and any property not included in the transaction before collection. KNZ is not agreeing to store personal items left inside the vehicle.
6. Vehicle Pickup & Property Access
Pickup is arranged for an agreed location and is subject to vehicle requirements, safe access and availability. Unless expressly confirmed, an estimated pickup time is not a guaranteed arrival time.
You confirm that you are authorised to allow KNZ and any engaged towing operator to access the pickup location. You should identify gates, height limits, parking restrictions, building rules, underground access, locked wheels or other obstacles in advance.
KNZ or the towing operator may postpone or decline collection where access is unsafe, unlawful, materially different from what was disclosed or likely to cause unreasonable risk to people, vehicles or property. The parties may discuss a safer alternative arrangement.
7. Payment, Documents & Vehicle Transfer
The agreed price, payment method and required documents should be confirmed before the vehicle is transferred. Do not sign ownership-transfer documents until the agreed payment arrangement is clear and you are satisfied that payment has been made or properly provided.
You agree to complete documents reasonably required for a lawful vehicle sale, transfer or collection. KNZ will provide or complete documents it is legally responsible for. Responsibility for registration plates, notices, transfer steps, fees and other requirements will be handled according to applicable Victorian law and the agreed transaction.
No website statement should be treated as overriding a legal requirement relating to registration, written-off vehicles, motor car trading, second-hand dealing or vehicle ownership.
8. Changes, Delays & Cancellations
If you need to change or cancel an agreed pickup, contact KNZ as soon as possible. KNZ may also need to reschedule because of towing availability, traffic, weather, safety, access issues, vehicle requirements or events outside reasonable control.
No cancellation, call-out or additional towing fee applies unless it has been clearly disclosed and agreed in advance and is lawful. If a new fee or materially different arrangement is proposed, you may decide whether to accept it before proceeding.
Neither party is required to complete a proposed sale before final agreement, lawful documentation and the agreed transfer steps, subject to any rights or obligations that have already arisen.
9. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or another law where that right cannot lawfully be excluded, restricted or modified.
Where KNZ supplies services covered by mandatory consumer guarantees, those services must meet the standards required by law. Any remedy will be determined under the applicable law and the circumstances of the service.
10. Liability
To the maximum extent permitted by law, KNZ is not responsible for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by inaccurate information, unauthorised instructions, undisclosed hazards, unsafe access, or events outside KNZ’s reasonable control.
This limitation does not apply to liability that cannot lawfully be excluded or limited, including applicable Australian Consumer Law rights. Nothing in these terms excludes liability for fraud, wilful misconduct or any other liability that the law does not permit KNZ to exclude.
You remain responsible for securing the pickup area, removing personal items and accurately disclosing known conditions that may affect safe collection.
11. Acceptable Website Use & Intellectual Property
You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with operation, submit false or unlawful enquiries, or use website content in a way that infringes another person’s rights.
Unless otherwise stated, the website design, text, branding, graphics and original content belong to KNZ or are used with permission. You may view the website for personal or legitimate business-enquiry purposes but may not reproduce substantial content without permission.
Links to external websites are provided for convenience. KNZ does not control and is not responsible for third-party content, availability or practices.
12. General Terms
Privacy
Personal information is handled as described in the KNZ Privacy Policy.
Severability
If a court or authority finds part of these terms invalid or unenforceable, that part will be read down or removed to the minimum extent necessary, and the remaining terms will continue where legally possible.
No waiver
A delay in exercising a right does not automatically waive that right.
Governing law
These terms are governed by the laws applying in Victoria, Australia. Nothing in this clause prevents a person from relying on a jurisdiction or forum available under applicable law.
Updates
KNZ may update these website terms from time to time. Updated terms apply from the effective date shown on this page and do not retrospectively remove rights already accrued.
13. Contact KNZ
Contact KNZ if you have a question about these terms, a vehicle quote or an agreed pickup.
